MILEAGE PAYMENTS

Section 287.140.1 RSMo., provides:

“When an employee is required to submit to a medical examination or necessary medical treatment at a place outside of the local or metropolitan area from the place of injury or the place of residents.” (Emphasis added). The employer and insurer shall advance or reimburse the employee for all necessary and reasonable expenses.

In Smith v Francis Howell School District, Inj. No. 00-019748, (LIRC) 2001, the employee requested reimbursement at the State mileage allowance rate in effect on the date of the injury. The employer offered a Missouri State Highway Map, distributed by MODOT (Missouri Department of Transportation) which showed the area of represented to be the “St. Louis area”. The Court took judicial notice that the “metropolitan area shown in the MODOT official map is the “St. Louis area” which includes a portion of St. Charles County in the designation of St. Louis area.
