EMPLOYER-MAJOR NUMBER OF EMPLOYEES REQUIRED Construction Industry - Minimum of one

In Atkinson v Peterson/T&P Foundation, 962 S.W.2d 912 (Mo.App. S.D. 1998), a construction business owner with two employees was found liable for compensation benefits under the Act as an “employer” pursuant to 287.030.1(3). Under this 1990 amendment anyone engaged in the construction industry shall be considered an employer even if they only have one employee rather than five typically required under 287.090.1.
