Marc Middleton joined Evans & Dixon in 2023 as a Member in the firm's Kansas City office. He brings with him 16 years of experience as a trial attorney. Marc’s career has been focused on civil litigation, defending small and large businesses, individuals and municipalities against claims involving personal injuries (premises liability, auto collisions, etc.), labor and employment disputes (brought pursuant to the Missouri Human Rights Act (MHRA), the Whistleblower Protection Act (WPA), Title VII of the Civil Rights Act, the Fair Labor Standards Act (FLSA), the Americans with Disabilities Act (ADAAA), the Family and Medical Leave Act (FMLA), and the Missouri Merchandising Practices Act (MMPA), among others), construction defect and workers' compensation matters. Marc has handled every aspect of litigation from case inception through appeal. He has experience prosecuting and defending claims on behalf of his clients. Believing the best defense is a good offense, Marc utilizes targeted written discovery and depositions of key witnesses to protect his clients’ interests. While he strives to avoid the whims of a jury through motion practice and dispute resolution, he builds every case with the expectation that it will be tried. He has first chaired jury and bench trials throughout the state, federal and administrative courts of Missouri, Kansas, Iowa and Nebraska, with positive results.
Marc values close relationships with his clients and supports them with business needs on a full-service basis. He assists company leadership with contract negotiations, strategic decisions, risk assessment, management and mitigation, employment investigations, claim evaluations, and otherwise proactively ensures compliance with relevant laws and regulations. Once a claim is received, Marc outlines a clear strategy coupled with an honest and accurate evaluation of each matter. Recognizing that strategies change as the facts are developed, Marc always keeps his clients "in the loop" to ensure that every decision throughout the course of litigation is well-informed.
Marc was recognized by the Super Lawyers publication as a "Rising Star" each year from 2014 through 2021. In 2022, he was recognized as a "Super Lawyer" in the area of civil litigation. He often presents at seminars where he discusses both fundamental and emerging issues relating to his expansive practice.
