Brian has a wide-ranging litigation practice representing individuals, nonprofits, municipalities, businesses and insurance companies in courts throughout Missouri and Illinois. Brian advises his clients in best practices to avoid litigation, but also defends them when necessary--from pre-suit demand through the appeal. Brian also has extensive experience in document retention practices and e-discovery (including in class actions).

 

Some of Brian's recent highlights include:

 

           Defended a company sued by a former employee for various business torts and settled the case for $0.

           Represented a rural restaurant in a dram shop case ultimately dismissed by the plaintiff for $0.

           Obtained multiple summary judgments for overdue retroactive workers’ compensation insurance premiums in Missouri's residual market.

           Successfully had a fraud and false advertising case against a car dealership dismissed and successfully defended the judgment on appeal. 

           Obtained funds withheld by a bank for use by a local homeowners’ association.

           Obtained summary judgment on behalf of a local property owner in a $2 million indemnity dispute.

 

 

Before Brian joined Evans & Dixon in 2009, he was an associate in the commercial litigation group of a major regional law firm. There, Brian worked on a variety of commercial cases, include contract disputes, foreclosures, asbestos litigation, landlord-tenant and other property matters, and protecting the rights of creditors in bankruptcies and receiverships. In addition, Brian spent several months partnering with a major east coast law firm to hire, train, and supervise a team of lawyers handling the e-discovery portion of a complex international environmental lawsuit. 

 

Outside his law practice, Brian enjoys traveling the world, flying Cessnas, boating, and cheering on the St. Louis Cardinals. Brian also loves teaching students of all ages. For years, Brian tutored at-risk elementary school children, and has coached a nationally-ranked undergraduate mock trial program.
