In State ex rel Maloney v Allen, 26 S.W.3d 244 (Mo.App. W.D. 2000), employer, who wanted psychiatrist’s records of deceased employee must first show that the psychiatric care related tot the injuries suffered in the workers’ compensation case.  Anything else was subject to the doctor/patient privilege.
